RED Bull, a global energy drink manufacturing company has agreed to pay $13million compensation after some consumers complained that they couldn’t grow wings despite claims in their famous advertising slogan.
The false ad lawsuit all started in 2013 by a US consumer, Benjamin Careathers, who believed the company’s slogan “Red Bull gives you wings” is dishonest
The lawsuit said ‘such deceptive conduct and practices mean that [Red Bull’s] advertising and marketing is not just “puffery,” but is instead deceptive and fraudulent and is therefore actionable’.
‘Even though there is a lack of genuine scientific support for a claim that Red Bull branded energy drinks provide any more benefit to a consumer than a cup of coffee, the Red Bull defendants persistently and pervasively market their product as a superior source of “energy” worthy of a premium price over a cup of coffee or other sources of caffeine,’ the suit says
Since the company agreed to settle two class-action lawsuits this week, there has been an avalanche of visitors to their website to make claims for part of the cash though to be either a $10 cash payment or $15 in Red Bull product.
The website has crashed.
The US court has appointed an administrator to get the site running and help with the payment of the compensation.
The advert which run from January 2002 to October 3,2014 means those who bought a drink within that period qualify for some compensation.
